Issue: Whether the First Amendment prohibits viewpoint-, content-, or speaker-based laws restricting select websites from engaging in editorial choices about whether, and how, to publish and disseminate speech — or otherwise burdening those editorial choices through onerous operational and disclosure requirements. There are opinions from the Fifth and Eleventh Circuit reaching different conclusions on this issue.
Holding: The Supreme Court did not reach the issue in this case as stated above. Instead, the Supreme Court vacated and remanded because the Fifth and Eleventh Circuits did not conduct a proper analysis of the facial First Amendment challenges to the Texas and Florida statutes. The Court provided some guidance as to how the facial First Amendment issues should be addressed on remand. The Court opined that it is not likely to succeed in enforcing the statute against content moderation policies for the platforms' main feeds.
